SEGSP Terms of Adoption
1. Purpose of Adoption
Adopting Party understands and agrees that the Dog shall be used solely as a companion pet and shall not be used for breeding for any reason. Adopting Party agrees that the Dog shall permanently reside with the Adopting Party as an in-home companion pet. The Dog must not be maintained as an outdoor yard dog. The Dog must not be protection or attack trained or agitated in any manner or used as a guard dog for any agency, firm, corporation, organization, or otherwise. Adopting Party acknowledges receipt of the “Information for New Adopters,” has read the document, and agrees to
abide by the guidelines provided by SEGSP Rescue.
2. Complete and Truthful Information
Adopting Party expressly warrants that they have provided complete and truthful information to SEGSP Rescue in connection with their application and throughout the adoption process. Adopting Party further understands and agrees that the failure to
provide complete and truthful information to SE GSP Rescue constitutes a material breach of this Agreement.
3. Spay/ Neuter Requirement
If not already spayed or neutered, Adopting Party agrees to have a licensed veterinarian spay or neuter the Dog within the agreed timeframe outlined in the Adoption Agreement. If, however, Adopting Party provides SEGSP Rescue with a licensed veterinarian’s written recommendation for delaying the spaying or neutering beyond the agreed timeframe for health reasons, SEGSP Rescue will agree to extend this requirement in accordance with a veterinarian’s written recommendation. Adopting Party agrees that until altered, the Dog will not be allowed to interact with other unaltered animals including running off leash, visits to dog parks, visits to a pet daycare, or any other situation in which unaltered animals may
be permitted to interact. Adopting Party shall provide SEGSP Rescue written confirmation that the Dog has been spayed or neutered within 10 days of the procedure. Upon written receipt of proof of the procedure to SEGSP Rescue, SEGSP Rescue will
refund the Adopting Party $200.00 of the adoption fee. Adopting Party understands and agrees that failure to comply with any requirements of this provision voids the Agreement or otherwise and further subjects Adopting Party to termination of the Agreement.
4. Breed Identification
Adopting Party understands and agrees that SEGSP Rescue has not made any representations regarding the Dog’s breed or
family history.
5. Health/Welfare: Adopting Party agrees to provide the Dog with a safe and fit home, a continuous water supply, quality food, and necessary veterinary care, including deworming, heartworm prevention, and regular vaccinations. Adopting Party acknowledges receipt and has carefully read the “Individual Dog Information for Adopter” document for the Dog. Adopting
Party agrees the Dog will never be tethered/chained or left in a hot vehicle. If Adopting Party later becomes unable to provide the Dog with a suitable home and adequate care, Adopting Party agrees to immediately return the Dog to SEGSP Rescue for rehoming.
6. Assumption of Risk
Adopting Party understands and agrees that SEGSP Rescue has not made any representations regarding the behavior of the Dog and that SEGSP Rescue does not and cannot know the full history of the Dog, including any behavioral issues or dangerous propensities. Adopting Party further understands and agrees that there is inherent risk in adopting the Dog, and that any
behavioral issues and associated risks are often increased by the presence of young children. Consequently, Adopting Party represents that no children under the age of six (6) years old lives in the home at the time the Agreement is executed. Adopting Party expressly assumes any and all risk and accepts full personal responsibility for any and all liability and damages relating to the Dog.
7. Returns
If, for any reason, this adoption is not satisfactory to Adopting Party or if Adopting Party fails to comply with the terms of the Agreement at any time during the life of the Dog, the Dog must be returned to SEGSP Rescue. Under no circumstances may Adopting Party sell, transfer, or otherwise re-home the Dog or release the Dog to a shelter or pound without
consultation and express approval from SEGSP Rescue.
8. Refunds
If the Dog is returned within thirty (30) days of adoption and is in good or better mental and physical condition as it was on the date of the Agreement, there may be a prorated refund of the adoption donation at the complete discretion of the rescue agent. There will be no refund after thirty (30) days. The Adopting Party is welcome to elect to leave the donation with SEGSP Rescue to assist with its mission.
9. Identification
The Dog must wear identification at all times in the form of a clearly marked collar. The Dog’s microchip number is contained in Section I of the Agreement. This number will be registered by SEGSP Rescue with HomeAgain (www.HomeAgain.com). This is a lifetime registration. Enrollment in HomeAgain’s other services (i.e. membership) can be purchased as an optional annual subscription. If you choose not to enroll in their annual membership, your lifetime membership will still be active. Please refer to their website for details of HomeAgain’s optional membership and fee.
10. Lost or Stolen
If the Dog is lost or stolen, SE GSP Rescue must be notified immediately via email ([email protected]). Current state coordinator information can be found on SE GSP Rescue website (www.segsprescue.org) under available dogs and the state in which you reside.
11. Reservation of Rights/Home Visits
SEGSP Rescue reserves the right to arrange follow-up visits to the Adopting Party’s home and to contact the Dog’s veterinarian to ascertain if all conditions and requirements of the Agreement are being upheld. Should any term or condition of the Agreement not be upheld, SEGSP Rescue reserves the right to terminate the Agreement and the Dog must be returned to SEGSP Rescue.
12. Remedies for Breach
Adopting Party understands and agrees that in the event that Adopting Party breaches any provision of this Agreement, SEGSP Rescue shall be entitled to the immediate return of the Dog to SEGSP Rescue without refund. Adopting Party further understands and agrees that this remedy shall be in addition to all other remedies at law and equity, including but not limited to SEGSP Rescue’s right to recover its attorneys’ fees and costs as provided herein.
13. Attorney Fees and Costs
Should it be necessary for SEGSP Rescue to take legal action to recover the Dog or otherwise enforce provisions in the Agreement, SEGSP Rescue shall be entitled to recover from Adopting Party its reasonable attorneys’ fees and costs.
14. Indemnity and Release
If any action or failure to act on the part of Adopting Party shall result in any claim, suit, loss, damage, injury, death, or liability, Adopting Party agrees to defend, indemnify, and hold SEGSP Rescue harmless and to pay all of SEGSP Rescue’s costs and expenses, including reasonable legal fees, any amount paid in settlement, and any award or judgment with respect thereto.
Adopting Party releases SEGSP Rescue, including its agents and volunteers and their heirs from any and all liability, costs, or damages caused by or related to the Dog, including but not limited to damage to or destruction of property, injury to any person, or expenses incurred by Adopting Party relating to the Dog.
15. Governing Law
The Agreement shall be governed by and construed in accordance with the laws of the State listed in the Adoption Agreement.
16. Opportunity to Consult with Counsel
The Parties hereby represent and acknowledge that they have been provided with the opportunity to discuss and review the terms of the Agreement with any respective attorneys before signing it and that they are freely and voluntarily signing this document. The Parties further represent and acknowledge that they have been provided a reasonable period of time within which to review the terms of the Agreement.
17. Entire Agreement
The Agreement represents the entire agreement between the parties. SEGSP Rescue and Adopting Party have made no other
agreements, promises, representations, or warranties, express or implied, unless specifically stated in the Agreement. No alteration of or amendment to the Agreement shall be effective unless given in writing and signed by the party or parties sought to be charged or bound by the alteration or amendment.
